Our Refund Policy

The user (hereby the Client) of ApplyAway Immigration Services acknowledges that the granting of a visa or status and the time required for processing this application is at the sole discretion of the Government of Canada and not ApplyAway Immigration Services Inc. or the RCIC(s) and staff they employ. Furthermore, the Client acknowledges that fees are not refundable in the event of an application refusal.

If, however, there is a problem regarding the successful submission of the Client's application to the Government of Canada, ApplyAway will refund all of the fees collected. The Client agrees that ApplyAway's service fees are paid for the sole purpose of submitting the application with the complete information as provided by the Client, and any refund is strictly limited to the amount of fees paid.

Eligible fees will be refunded in the following manner:

  • Upon meeting the refund eligibility criteria, ApplyAway Immigration Services Inc. will initiate the refund process within 30 working days.
  • The time it takes for the refunded amount to be credited or received by the client may vary depending on the payment provider and financial institutions involved.
  • ApplyAway Immigration Services Inc. will not be held responsible for any delays caused by external payment processors or financial institutions.

Our Dispute Resolution Policy

In the event of a dispute related to the Code of Professional Ethics (https://college-ic.ca/protecting-the-public/code-of-professional-conduct), the Client and ApplyAway are to make every effort to resolve the matter between the two parties. In the event a resolution cannot be reached, the Client is to present the complaint in writing to ApplyAway and allow our RCICs 30 days to respond to the Client. In the event the dispute is still unresolved, the Client may follow the complaints and discipline procedure outlined by the College on their website (https://college-ic.ca/protecting-the-public/complaints-process).

The College may require the production of documents in accordance with the "College of Immigration and Citizenship Consultants Act". Our Confidentiality Policy

All information and documentation used for the preparation of the application will not be divulged to any third party, other than agents and employees, without prior consent, except as demanded by law. As a corporation registered with College of Immigration and Citizenship Consultants, all ApplyAway RCICs, and all agents and employees of the RCICs, are also bound by the confidentiality requirements of Article 8 of the Code of Professional Ethics (https://college-ic.ca/protecting-the-public/code-of-professional-conduct).

The personal information collected on an application, and other information collected in support of an application, may be used for computer analytics to support processing of applications and decision making, including your application. Personal information, including from advanced analytics, automation, and other technologies, may also be used for purposes including research, statistics, program and policy evaluation, internal audit, compliance, risk management, strategy development and reporting.

The Client agrees to the use of electronic communication and storage of confidential information. ApplyAway will use its best efforts to maintain the highest degree of security for electronic communication and information storage.

Government of Canada's Privacy Notice

Personal information collected will be used, disclosed, and retained by Immigration, Refugees and Citizenship Canada (IRCC) under the authority of the Immigration and Refugee Protection Act (IRPA). The personal information provided will be used for the purpose of processing applications. The personal information provided may be disclosed to other federal government institutions and third parties including law enforcement bodies, regulatory bodies, investigative bodies, provincial/territorial governments and/or foreign governments, for the purpose of supporting an investigation and validating identity, information, eligibility, and admissibility.

The personal information collected on an application, and other information collected in support of an application, may be used for computer analytics to support processing of applications and decision making, including your application. Personal information, including from advanced analytics, automation, and other technologies, may also be used for purposes including research, statistics, program and policy evaluation, internal audit, compliance, risk management, strategy development and reporting.

Where biometrics are provided in support of an application, the fingerprints collected will be stored and shared with the RCMP. The fingerprint record may also be disclosed to law enforcement agencies in Canada in accordance with subsection 13.11(1) of the Immigration and Refugee Protection Regulations. The information may be used to establish or verify the identity of a person in order to prevent, investigate, or prosecute an offence under any law of Canada or a Province. This information may also be used to establish or verify the identity of an individual whose identity cannot reasonably be otherwise established or verified because of physical or mental condition. Canada may also share immigration information related to biometric records with foreign governments with whom Canada has an agreement or arrangement.

Failure to provide complete information may result in a delay or the application not being processed. The Privacy Act gives individuals the right of access to, protection, and correction of their personal information. Further details are available in Info Source. If you are not satisfied with the manner in which IRCC handles your personal information, you may exercise your right to file a complaint to the Office of the Privacy Commissioner of Canada.
